Terms of Service

These Terms of Service ("Terms") set out the conditions for using the web service "EPUB FACTORY" (in Japanese: EPUB工房; "the Service") provided by EPUB FACTORY Operations ("the Operator"). By using the Service, you ("the User") are deemed to have agreed to these Terms.

Article 1 (Scope)

  1. These Terms apply to all relationships between the User and the Operator regarding use of the Service.
  2. The User is deemed to have agreed to all of these Terms at the moment they use the Service.

Article 2 (The Service)

  1. The Service is a tool that converts images and text specified by the User into EPUB ebook files inside the User's web browser.
  2. All conversion takes place on the User's device (browser). Images, manuscripts and generated EPUB files are never sent to or stored on the Operator's servers. See the Privacy Policy for details.
  3. The Service requires no account and is free for everyone to use.

Article 3 (Fees)

Use of the Service is free of charge. Communication devices, software, network fees and any other environment necessary to use the Service shall be prepared at the User's own expense and responsibility.

Article 4 (Prohibited Acts)

When using the Service, the User must not:

  1. Violate laws or public order and morals, or act in a way likely to do so.
  2. Process images or content that infringes third-party copyrights, trademarks or other intellectual-property rights, portrait rights, privacy or any other rights.
  3. Convert works or manuscripts of others without authorization. The User is solely responsible for confirming that they hold the necessary rights to the content they convert.
  4. Copy, modify, adapt, reverse engineer, decompile, disassemble or otherwise analyze the programs that make up the Service (including all JavaScript, WebAssembly, Python source code and other programs/scripts).
  5. Extract, repurpose or redistribute, without permission, all or part of the aforementioned programs, designs, logos, texts or any other element of the Service, or use them for the purpose of building or providing a service or product identical or similar to the Service.
  6. Place excessive load on the Service's servers or networks, perform automated mass access or scraping, or otherwise interfere with the operation of the Service.
  7. Gain, or attempt to gain, unauthorized access to the Service.
  8. Transmit or write computer viruses or other harmful programs.
  9. Engage in any other act the Operator reasonably deems inappropriate.

If the Operator determines that a User has violated this Article, the Operator may restrict that User's use of the Service or take other necessary measures without prior notice.

Article 5 (Intellectual Property)

  1. All intellectual-property rights, including copyright, in the Service and its programs, source code, designs, logos, texts and all other works belong to the Operator or their rightful holders.
  2. Permission to use the Service under these Terms does not constitute an assignment or license of the aforementioned intellectual-property rights to the User.
  3. Rights to images converted and EPUB files generated by the User belong to the User or the rightful holder of that content. The Operator acquires no rights whatsoever to such content.

Article 6 (User Responsibility)

  1. The User uses the Service at their own responsibility.
  2. As the Service processes data on the User's device, saving generated files and backing up source data is the User's own responsibility. The Operator does not retain User data.
  3. When submitting or distributing converted content to ebook stores or other third-party services, the User is solely responsible for confirming compliance with those services' specifications and review standards.

Article 7 (Disclaimers)

  1. The Service is provided "as is". The Operator makes no warranty, express or implied, as to its completeness, accuracy, usefulness, fitness for a particular purpose or continued availability.
  2. The Operator does not guarantee the accuracy or validity of conversion results or internal checks, nor that generated EPUB files will display correctly or be accepted on every reader, device or distribution platform.
  3. The Operator is not liable for any damage arising from use of, or inability to use, the Service (including data loss or corruption, lost profits, lost business opportunities and any other direct or indirect damage), except in cases of the Operator's willful misconduct or gross negligence.
  4. The Service relies on external content-delivery networks (CDNs), hosting providers and other third-party services. The Operator is not responsible for failures, delays or outages attributable to such third-party services.
  5. The Operator bears no responsibility for disputes between the User and third parties, which shall be resolved at the User's own responsibility and expense.
  6. Even where the Operator bears liability for damages in connection with the Service, except in cases of willful misconduct or gross negligence, such liability is limited to ordinary and direct damage actually incurred by the User, and is limited to a reasonable extent in light of the Service being provided free of charge.

Article 8 (Changes, Suspension and Termination)

  1. The Operator may change, add to, suspend or terminate all or part of the Service without prior notice to Users.
  2. The Operator bears no responsibility for damage incurred by Users as a result of measures under the preceding paragraph.

Article 9 (Amendments to these Terms)

The Operator may amend these Terms without notifying Users when it deems necessary. Amended Terms take effect when posted on the Service, and continued use of the Service after amendment constitutes agreement to the amended Terms.

Article 10 (Governing Law and Jurisdiction)

  1. These Terms are governed by and construed in accordance with the laws of Japan.
  2. Any dispute between the Operator and a User in connection with the Service shall be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the Operator's location, as the court of first instance.
